1. Important Note About Medical Care

Elite HRT operates an online storefront. The medical consultations, prescription evaluations, and clinical care available through the Site are provided by Beluga Health, an independent, physician-led telehealth platform. Beluga Health is the entity responsible for collecting, storing, and protecting your protected health information ("PHI") in connection with your care.

When you engage with a clinician through Beluga Health, your interactions, medical history, lab results, prescriptions, and any other clinical information are handled under Beluga Health's own privacy notice and applicable health privacy laws, including HIPAA. Please review Beluga Health's Notice of Privacy Practices for details about how your health information is handled in that context.

Elite HRT does not receive, store, or have access to your clinical records, lab results, or PHI generated through your Beluga Health consultation. This Privacy Policy covers only the information Elite HRT itself collects through this Site (for example, your account details, shipping address, and purchase history).

2. Information We Collect

We collect information in three ways: information you give us, information collected automatically, and information from third parties.

2.1 Information You Provide

  • Account information: name, email address, phone number, password

  • Order information: shipping address, billing address, products purchased

  • Payment information: payment is processed by Stripe, Inc. We do not store full credit card numbers on our servers. We receive limited information from Stripe such as the last four digits of your card, card brand, and authorization status

  • Communications: if you contact our customer support, we keep a record of the correspondence

  • Marketing preferences: your subscription status for email or SMS marketing

2.2 Information Collected Automatically

When you visit the Site, we (and our service providers) automatically collect:

  • Device and browser data: IP address, browser type, operating system, device identifiers, referring URLs

  • Usage data: pages viewed, links clicked, time spent on pages, session duration

  • Location data: approximate location derived from your IP address

  • Cookies and similar technologies: see Section 6 for details

2.3 Information from Third Parties

  • Beluga Health: we may receive confirmation that a prescription has been issued and is eligible to be fulfilled, along with the order details necessary to ship the product. We do not receive the underlying clinical information that supports that prescription.

  • Payment processor (Stripe): transaction status and limited card metadata as described above

  • Shipping carriers: delivery status updates

  • Marketing and analytics providers: aggregated insights about Site performance

3. How We Use Information

We use the information we collect to:

  • Process and fulfill your orders, including coordinating with Beluga Health and our shipping partners

  • Communicate with you about your orders, account, and customer support inquiries

  • Send marketing communications, where you have opted in (you may unsubscribe at any time)

  • Operate, maintain, and improve the Site

  • Detect and prevent fraud, abuse, and security incidents

  • Comply with legal obligations and enforce our Terms of Service

  • Conduct analytics to understand how customers use the Site

We do not sell your personal information for money. To the extent that our use of cookies or analytics tools constitutes "sharing" or "selling" under certain state privacy laws, see Section 7 for your rights.

4. How We Share Information

We share information only with parties who help us operate the Site and serve you, or where required by law. These include:

  • Beluga Health: to coordinate your care and verify prescription eligibility

  • Stripe: to process payments

  • Shopify, Inc.: our ecommerce platform host

  • Shipping carriers: (e.g., USPS, UPS, FedEx) to deliver your orders

  • Email and SMS service providers: (e.g., Klaviyo) to send transactional and marketing messages

  • Analytics providers: (e.g., Google Analytics, Shopify Analytics) to understand Site usage

  • Advertising partners: to deliver and measure marketing campaigns, where permitted

  • Professional advisors: lawyers, accountants, and similar service providers under confidentiality obligations

  • Authorities and other parties: when required by law, subpoena, court order, or to protect our rights, property, or safety, or that of others

  • Business transfers: in connection with a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction

We do not share your information with third parties for their own independent marketing without your consent.

5. Health Information and HIPAA

Elite HRT is not a covered entity or business associate under HIPAA with respect to the information it collects through the Site. The clinical care provided through Beluga Health is subject to HIPAA and to Beluga Health's own privacy practices.

You should not submit detailed medical history, symptoms, or other PHI to Elite HRT through customer support, contact forms, or other Site channels. If you do, we will treat that information as confidential and will not use it for any purpose other than responding to your inquiry, but we cannot guarantee HIPAA-level protections for information transmitted outside Beluga Health's platform.

6. Cookies and Tracking Technologies

We use cookies, pixels, and similar technologies for purposes including:

  • Strictly necessary: keeping you logged in, maintaining your cart, securing the Site

  • Performance and analytics: understanding how the Site is used

  • Marketing: measuring the performance of our advertising and showing you relevant ads

You can control cookies through your browser settings. Blocking certain cookies may affect Site functionality. Where required by law, we present a cookie banner allowing you to manage preferences.

We honor Global Privacy Control (GPC) signals where applicable.

7. Your Privacy Rights

Depending on where you live, you may have rights regarding your personal information:

7.1 California (CCPA / CPRA)

If you are a California resident, you have the right to:

  • Know what categories of personal information we collect, the sources, and the purposes

  • Access a copy of the specific personal information we hold about you

  • Request deletion of your personal information

  • Correct inaccurate personal information

  • Opt out of the "sale" or "sharing" of personal information for cross-context behavioral advertising

  • Limit the use of sensitive personal information

  • Be free from retaliation for exercising these rights

7.2 Other U.S. States

If you reside in Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia (or any other state with a comprehensive privacy law in effect), you have similar rights to access, delete, correct, and opt out of certain uses of your personal information. 7.3 International Users

The Site is operated from the United States and intended for U.S. residents. If you access the Site from outside the U.S., you understand that your information will be transferred to and processed in the United States, where data protection laws may differ from those in your country.

7.4 Appeals

If we decline your privacy request, you may appeal by contacting us at michael@elitehrt.com with "Privacy Appeal" in the subject line.

8. Data Retention

We retain personal information for as long as necessary to provide our services, comply with legal obligations, resolve disputes, and enforce our agreements. Order records are typically retained for at least seven (7) years to meet tax and recordkeeping requirements. Marketing data is retained until you unsubscribe or request deletion.

9. Data Security

We use commercially reasonable administrative, technical, and physical safeguards to protect your information. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

10. Children's Privacy

The Site and the underlying telehealth services are intended for adults 18 years of age or older. We do not knowingly collect personal information from minors. If you believe a minor has provided us with personal information, contact us at michael@elitehrt.com and we will take steps to delete it.

The Site may contain links to third-party websites, including Beluga Health. We are not responsible for the privacy practices of those third parties. Please review their privacy policies separately.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Material changes will be communicated through the Site or, where appropriate, by email. Continued use of the Site after changes take effect constitutes acceptance of the revised Privacy Policy.
